2. EU Right of Withdrawal
Important Information for EU Consumers
Under EU consumer law, you normally have the right to withdraw from a distance contract within 14 days without giving any reason. However, this right of withdrawal does not apply to our products for the following reasons (as per EU Directive 2011/83/EU, Article 16):
2.1 Custom-Made Products Exception
Printed books are made to your specifications and clearly personalized. Each book is uniquely generated based on your character name, story preferences, and uploaded photo. Under Article 16(c) of the Consumer Rights Directive, the right of withdrawal does not apply to "the supply of goods that are made to the consumer's specifications or are clearly personalized."
2.2 Digital Content Exception
Digital files (EPUB/PDF) are delivered immediately after generation. By completing your purchase, you expressly consent to the immediate delivery of digital content and acknowledge that you lose your right of withdrawal once the download becomes available. This is in accordance with Article 16(m) of the Consumer Rights Directive regarding digital content.
3. AI-Generated Content Notice
Please understand: All stories and illustrations are generated by artificial intelligence and are not reviewed by human editors or artists before delivery. AI-generated content may include narrative variations, stylistic differences, or creative interpretations that differ from your expectations. These are characteristics of AI technology, not defects, and do not qualify for refunds.
4. Digital Products (EPUB and PDF Files)
Digital story files are final sale. Refunds are not available for:
- Downloaded or accessed digital files
- Dissatisfaction with the AI-generated story, plot, or character development
- Artistic style or quality of AI-generated illustrations
- Grammatical or narrative variations in the generated text
Technical issues: If you experience problems downloading or opening your files (corrupted files, broken links), contact us and we will provide replacement files at no charge.
5. Physical Products (Printed Books)
5.1 When We Will Issue a Refund or Replacement
Although printed books are custom-made and generally non-refundable, we will provide a refund or replacement (at our discretion) in the following cases:
- Damaged in transit: Book arrives with physical damage (torn pages, bent covers, water damage) — report within 14 days of delivery with photos
- Manufacturing defects: Printing errors such as missing pages, upside-down printing, blank pages, or binding failures — report within 14 days of delivery
- Wrong item: You receive a book that doesn't match your order — report immediately
- Non-delivery: Order not delivered despite shipping confirmation — report after reasonable delivery window has passed
5.2 What Does Not Qualify for Refund
We cannot offer refunds or returns for:
- Dissatisfaction with the AI-generated story content, plot, or narrative
- Quality or style of AI-generated illustrations
- Grammatical variations or creative interpretations in the text
- Minor print quality variations within industry standards
- Books that have been used, written in, or show wear beyond transit damage
- Change of mind after ordering
- Issues reported more than 14 days after delivery
6. How to Request a Refund
If you believe your order qualifies for a refund under Section 5.1:
- Email us at hi@talesofus.ai within 14 days of delivery
- Include:
- Your order number
- Clear photos showing the issue (for damage or defects)
- A brief description of the problem
- Wait for our response — we aim to reply within 48 business hours
- If approved: We will provide instructions for return (if needed) or process your refund/replacement
7. Refund Processing
When a refund is approved:
- Refunds are processed within 14 days of approval
- Refunds are issued to the original payment method
- Original shipping costs are refunded only if the return is due to our error or a defective product
- For replacements, we cover the cost of reprinting and reshipping
8. Cancellations
8.1 Before Generation Begins
You may cancel your order and receive a full refund if you contact us before AI generation has started. Once we begin generating your personalized story, cancellation is no longer possible.
8.2 After Generation Begins
Once AI generation has begun, the order cannot be cancelled because:
- Computational resources have been utilized
- Your personalized content has been created
- For physical books: print production may have already been submitted
9. Warranty on Physical Products
Our printed books are produced by Lulu.com using professional print-on-demand processes. While we do not provide a formal warranty, we stand behind the physical quality of our products:
- Books should arrive in good condition with proper binding and print quality
- Manufacturing defects will be addressed as described in Section 5.1
- Print quality is subject to standard variations in digital print-on-demand production
10. Statutory Consumer Rights
This Return Policy does not limit or affect your statutory rights under applicable consumer protection laws. In particular:
- EU consumers: You retain all rights under the Consumer Rights Directive (2011/83/EU) and the Consumer Sales Directive (2019/771), including the right to a remedy for goods that do not conform to the contract
- Dutch consumers: Your rights under the Dutch Civil Code (Burgerlijk Wetboek) are fully preserved
Where mandatory consumer protection laws provide greater protection than this policy, those laws prevail.
11. Exceptions
We may make exceptions to this policy in extraordinary circumstances at our sole discretion. Any exception granted does not create a precedent or obligation for future cases.
12. Changes to This Policy
We may update this Return Policy from time to time. Changes will be posted on our website with an updated "Last updated" date. Changes do not affect orders placed before the update.
